Andrew C. Finch
Partner
A partner in the Litigation Department, Andrew Finch has extensive litigation experience, including trial and appellate matters, as well as civil and criminal government investigations. Since joining Paul, Weiss in 2005, his work has included:
  • Defending a major insurance company against antitrust claims brought in federal and state courts by commercial insureds alleging bid rigging, market allocation, and the improper use of broker commissions.

  • Defending MasterCard against antitrust claims brought by a putative class of merchants in the United States that are challenging the credit card interchange system as a form of price fixing in violation of the Sherman Act.

  • Representing two publishers in obtaining the dismissal of an antitrust lawsuit involving the distribution of interest rates and other information about financial products over the Internet.

  • Representing clients in antitrust investigations by the Federal Trade Commission, the United States Department of Justice, and numerous state attorneys general.

  • Successfully representing at trial a client asserting defamation and extortion claims.

  • Counseling clients on a wide variety of antitrust and other issues arising in the business and litigation contexts, including interlocking directorates, price discrimination, exclusive dealing, resale price maintenance, and trade secrets.

Mr. Finch joined the firm from the Antitrust Division of the United States Department of Justice (DOJ), where he served as Counsel to the Assistant Attorney General. While at the Antitrust Division, Mr. Finch worked closely with Assistant Attorneys General and Deputies on civil merger and non-merger investigations, matters proceeding to trial, and appeals.

Mr. Finch has also engaged in a number of projects involving the application of antitrust law to intellectual property. While at the DOJ, he participated in drafting the joint report of the DOJ and Federal Trade Commission titled Antitrust Enforcement and Intellectual Property Rights: Promoting Innovation and Competition, and was a contributor to the Report of the DOJ’s Task Force on Intellectual Property.

While at the University of Chicago Law School, Mr. Finch was a John M. Olin Student Fellow in Law and Economics, the Topics and Comments Editor of The University of Chicago Law Review, and was elected to the Order of the Coif. Mr. Finch is a member of the American Bar Association’s Section of Antitrust Law and served as a vice-chair of the Section’s Civil Practice and Procedure Committee. He previously served as a member of the Editorial Board of Antitrust Law Developments (Sixth), and was the principal editor of the Section’s recently published Handbook on Interlocking Directorates.

He is admitted to practice in New York, California and the District of Columbia.
