Description of Program and Relief

Good Samaritan Protections for COVID-19 Frontline Workers

Pursuant to Executive Order 2020-27, licensed Arizona healthcare professionals and volunteer health professionals registered and recruited through the Arizona Emergency System for the Advance Registration of Volunteer Health Professionals who provide medical services in Arizona during the COVID-19 emergency, are presumed to have acted in good faith and are immune from civil liability. The same protections apply to any licensed Arizona Emergency Medical Care Technician who provides emergency care services during the COVID-19 emergency.

Any Arizona healthcare professional, licensed Arizona healthcare institution, any entity operating a modular field treatment facility, or other site whether or not it is a licensed healthcare institution, designated by the Director of the Arizona Department of Health Services for temporary use in support of the State’s COVID-19 emergency response, or an Emergency Medical Care Technician, is immune from civil liability for good faith triage decisions.

The immunities granted pursuant to the Executive Order for actions undertaken during the term of the order will survive expiration of the Executive Order.

The Executive Order does not provide immunity from civil liability for gross negligence or reckless or willful misconduct.
