A senior partner in the Litigation Department and member of the firm's Management Committee, Leslie Gordon Fagen has litigated on behalf of plaintiffs and defendants for over 30 years, handling clients’ most complex civil litigation matters.
Mr. Fagen is recognized for his broad experience across an array of legal disciplines, including general commercial litigation, antitrust, insurance, intellectual property, product liability, real estate litigation and securities law issues, and is noted as a leading attorney for Commercial Litigation by

Mr. Fagen has served as co-chair of the firm's Litigation Department.
He is a Fellow of the American College of Trial Lawyers.
Mr. Fagen has a strong track record of wins and favorable settlements at the trial and appellate levels in federal and state courts across multiple jurisdictions, and in alternative dispute resolution proceedings. Some of his illustrative case work includes:
- a victory for clients, ACNielsen, Dun & Bradstreet and IMS Health, in a complex antitrust case brought by a competitor in the retail tracking industry and seeking over $2 billion in damages. Mr. Fagen helped obtain rulings that led the plaintiff to agree to dismiss the case with prejudice and on the merits;
- representation of major private equity companies in substantial disputes concerning breach of warranties and representations in connection with acquisitions;
- litigation of cutting edge disputes relating to defective products and environmental insurance, winning summary judgment on several coverage issues of first impression in the courts of the state of New York. One such case involved his representation of parties in connection with litigations concerning allegedly defective components used in nuclear power plants in several locations in the United States and abroad;
- representation of one of the world’s largest medical device manufacturers in product liability defense work all over the country including class action litigation in Texas, New York, New Jersey, Pennsylvania, Ohio, California, Illinois, Florida, South Carolina and Oklahoma;
- experience litigating and advising on copyright infringement and trademark/licensing negotiations and disputes for clients in the motion picture, television, publishing, fashion and cosmetics industries. Most recently he achieved victories on behalf of Polo Ralph Lauren in a jury trial and an international arbitration related to its ongoing trademark disputes with the United States Polo Association;
- representation of defendants in major Rule 10b-5, initial public offering and insider trading litigations and investigations;
- the prosecution of claims relating to defective high-speed trains, transit cars and buses, and other rail equipment sold for use in major metropolitan areas; and
- a court appointment to represent all future claimants who fall victim to asbestos-related disease in connection with a class action to restructure the Manville Personal Injury Settlement Trust.

He is an adjunct lecturer in law at Columbia Law School and an adjunct professor of law at Brooklyn Law School.
He is a member of the Association of the Bar of the City of New York, and has served on several Bar committees, including committees on the Judiciary, State Legislation and Transportation. He is also a member of the American Bar Association and International Bar Association, and has been a member of the New York State Bar Association Section of Commercial and Federal Litigation, where he served as chairman of the Committee on Magistrate Judges.
Mr. Fagen is a director of the Lawyers Committee for Civil Rights Under Law. He has served as a member of the Board of Trustees of Maimonides Medical Center, and trustee, president and vice chairman of The Educational Alliance, Inc., a multi-disciplinary social service agency.
