On March 10 Paul, Weiss hosted its annual Ethics CLE program, "Legal Ethics: Real World Issues." The faculty included litigation partner Michael E. Gertzman, corporate partner Valerie E. Radwaner, bankruptcy partner Andrew N. Rosenberg and alumnus Stephen Gillers, Emily Kempin Professor of Law at New York University School of Law. Panelists discussed several ethical issues, including:
- Common Interest Agreements, Joint Representations and the Joint Defense Privilege: What are they? How do they work? What precautions should be taken in entering into such arrangements?
- Negotiation Ethics: What must a lawyer do upon learning that a client has lied in a negotiation? What constitutes a "false" statement of fact within the meaning of the relevant rules? How do New York's rules differ from those in states that have adopted the ABA's Model Rules, and which rules apply?
- Ethical Risks in Social Networking: Social networks (LinkedIn, Facebook, Twitter) differ from law firm websites and create greater risks in the realms of confidentiality, unauthorized practice, conflicts, creation of professional relationships with attendant responsibilities, and unethical advertising and solicitation. How can lawyers, firms and in-house legal departments minimize risks while navigating this new world?
- Responsibility for Real Evidence: What should a lawyer do when a client gives him or her real evidence potentially relevant to a civil or criminal matter that is pending, impending or foreseeable? What do the ethics rules and the state and federal laws of obstruction of justice require or permit?
