Hailo Secures Major Victory Enabling E-Hail Application in New York City

In a major victory for Paul, Weiss client Hailo Network USA, Inc., the world's largest "e-hail" application provider, the First Department of the New York Appellate Division vacated a temporary restraining order that halted implementation of the New York City Taxi and Limousine Commission's e-hail pilot program. The pilot program expressly permits the use of e-hail applications, which allow passengers to seamlessly connect with available yellow cabs through smartphone software. Citing violations of the New York Administrative Code and the City Charter, a coalition of livery car industry members brought an Article 78 action to challenge the pilot as exceeding the City's authority. In May, the New York Supreme Court dismissed the case for lack of merit, and the livery coalition appealed to the Appellate Division, where they won entry of a temporary restraining order pending resolution of their appeal. The temporary restraining order required the City to suspend the program and prevented application providers, including Hailo, from enjoying the benefits of program participation. 

On June 6, an Appellate Division panel vacated the temporary restraining order, permitting Hailo to once again participate in the pilot program and ensuring that New Yorkers will have continued access to the convenience of e-hailing.
