Paul, Weiss and the Legal Aid Society Obtain Reversal of Client's Criminal Convictions

A state appeals court reversed the criminal convictions of a Paul, Weiss and Legal Aid Society client, finding the verdict to be "inherently inconsistent." The charges stemmed from a scuffle with a shopkeeper in the presence of the client's children. In addition to assault, the client was charged with endangering the welfare of his children because they witnessed the alleged assaults. The jury acquitted the client of each count of assault but convicted on two counts of endangering the welfare of a child. Given "the unitary nature" of the prosecution's trial theory, the appeals court reversed the endangering convictions as inconsistent in view of the evidence at trial.
