What Is Special About the Jurisdiction of the D.C. Circuit?

Litigation associate David Kessler co-authored an article that explores how the kinds of cases heard by the D.C. Circuit differ qualitatively and quantitatively from the kinds of cases heard by other federal courts. The study, which is the first empirical analysis of the Circuit's jurisdiction, concludes that Congress is more likely to grant the D.C. Circuit exclusive jurisdiction over (i) the review of administrative rulemaking (rather than over the review of agency adjudications), (ii) the review of independent agency actions (rather than over the review of executive agency actions) and (iii) matters that are likely to have national impact. The article, "The Jurisdiction of the D.C. Circuit," was published in Volume 23, Issue 1 of the Cornell Journal of Law and Public Policy.
