Pro Bono Client Wins in Housing Court

Paul, Weiss obtained a victory for a pro bono client in Queens County Housing Court when the Court refused to evict a disabled military veteran from his home of more than 45 years. Following oral argument, Judge Badillo of the Housing Court denied the Housing Authority's motion to vacate a permanent stay of the warrant of eviction that had previously been awarded to our client. Since 2008, the Housing Authority has been attempting to evict our client, a seriously ill and disabled military veteran, on the basis of a stipulation of exclusion signed by his now-deceased mother. Paul, Weiss has now litigated this case through an Article 78 proceeding and appeals, a subsequent action in Housing Court and the accompanying appeals, and the recent motion by the Housing Authority. In last week's decision in Housing Court, Paul, Weiss successfully argued that the Housing Authority lacked a valid procedural basis to bring a motion to vacate or modify the prior judgment, and that evicting our client would violate the interests of justice.

The Paul, Weiss team was supervised by litigation partner Claudia Hammerman and included associates Jacob Hupart and Asher Smith.
