VOLS Wins Unemployment Insurance Case for Pro Bono Client

Paul, Weiss, through the Volunteers of Legal Service's Advocacy Unemployment Insurance Project, obtained unemployment insurance benefits for a client who was discharged from her job as a medical assistant after placing a blood sample in the wrong test tube. The New York State Department of Labor had initially denied our client unemployment benefits, determining that her conduct constituted misconduct; however, after a hearing the administrative law judge overruled the Department of Labor's determination and held that our client was entitled to benefits because she did not receive a prior warning about the mistake.
