Litigation partners Lew Clayton and Eric Stone's Intellectual Property Litigation column appeared in the March 9 issue of the New York Law Journal. The article, "New Standard for Appellate Review of Patent Claim Construction," discusses the Supreme Court's recent patent law decision establishing the standard of appellate review for claim-construction decisions, and another recent Supreme Court decision resolving a circuit split by holding that a jury, not the court, should decide whether modifications to a trademark change the commercial impression of the mark.
