Second Circuit Review: Applying Strict Scrutiny to Laws Discriminating Against Nonimmigrants

Litigation partners Marty Flumenbaum and Brad Karp's Second Circuit Review column appeared in the August 22 issue of the New York Law Journal. The article, "Applying Strict Scrutiny to Laws Discriminating Against Nonimmigrants," discusses Dandamudi v. Tisch, in which the Second Circuit, applying strict scrutiny, held that a New York statute barring persons who were neither U.S. citizens nor legal permanent residents from obtaining  a pharmacist's license is unconstitutional and violates the Equal Protection Clause. Litigation associate Thomas Sullivan assisted in the preparation of the article.
