Second Circuit Review: Clarifying Bounds of Protected Speech for Public Employees

Litigation partners Martin Flumenbaum and Brad Karp's Second Circuit Review column appeared in the March 25 issue of the New York Law Journal. The article, "Clarifying Bounds of Protected Speech for Public Employees," discusses Matthews v. City of New York, in which the court found that when a public employee engages in speech pertaining to a subject that does not fall within the employee's duties, and does so in a manner in which ordinary citizens would be expected to engage, the employee speaks as a citizen whose speech is protected, not as a public employee, whose speech may be unprotected. Litigation associate Charles Hamilton assisted in the preparation of this column.
