Second Circuit Review: Court Affirms Grand Jury Subpoena for President

Litigation of counsel Martin Flumenbaum and firm chairman Brad Karp’s latest Second Circuit Review column, “Court Affirms Grand Jury Subpoena for President,” appeared in the October 28 issue of the New York Law Journal. The authors discuss the U.S. Court of Appeals for the Second Circuit’s decision to uphold, for the second time in a year, a 2019 grand jury subpoena served on President Donald Trump’s accounting firm for his financial and tax records. The decision reaffirms that a sitting president is subject to the same pleading standards and protections as every other citizen while challenging a grand jury subpoena, when the challenge does not express concerns related to the president’s Article II rights or duties.
