Litigation partners Martin Flumenbaum and Brad Karp’s latest Second Circuit Review column, “Court Applies Different Principles When Interpreting Injury in Fact,” was published in the July 26 issue of the New York Law Journal. The authors discuss two opinions handed down in May and June by the circuit that appear to apply different principles in interpreting injury in fact. Perhaps as a result of their different analyses, the opinions ordered different appellate dispositions.
