Litigation partners Martin Flumenbaum and Brad Karp’s latest Second Circuit Review column, “Fifth Amendment Prohibits Testimony Compelled by Foreign Sovereign,” was published in the August 30 issue of the New York Law Journal. The authors analyze a recent case where the court wrestled with the modern world’s reliance on foreign governments to help investigate and develop cases but declined to allow the government’s investigatory needs to outweigh defendants’ constitutional rights.
