Second Circuit Review: Recent Second Circuit Decisions Address Privacy in the Digital Age

Litigation partners Martin Flumenbaum and Brad Karp discuss U.S. v. Gilliam and U.S. v. Caraballo, two recent decisions by the U.S. Court of Appeals for the Second Circuit, that address the constitutionality of the government's use of location information obtained from global positioning systems (GPS). Although the Second Circuit affirmed the district court's approval of the government's conduct, the circuit court leaves open the question of at what point the information obtained violates an individual's Fourth Amendment right. The article, "Electronic GPS Tracking and the Fourth Amendment" appeared in the December 27 issue of the New York Law Journal. Associate Charles Hamilton assisted in the preparation of this article.
