Litigation partner Steven Baughman was quoted in a Bloomberg article discussing the declining number of petitions for covered business method (CBM) review at the U.S. Patent and Trademark Office’s Patent Trial and Appeal Board (PTAB). CBM petitions challenge the validity of patents (often involving business methods) that have a financial component. Despite the recent dip in filing statistics at the PTAB, Steven predicted covered business method petitions will remain “a powerful mechanism for challenging eligible patents” through the expiration date for CBM review in 2020.
