Paul, Weiss Secures Victory for Pro Bono Client in Yonkers Housing Court

Paul, Weiss secured a victory for a pro bono client in Yonkers Housing Court. Following an eviction petition brought by the landlord against our client and an ensuing $6,273 judgment against her, Paul, Weiss was engaged in the summer of 2019 to challenge that judgment. The court held hearings in June 2019, January 2020 and March 2022 on whether the landlord had violated the warranty of habitability. At the January 2020 hearing, associate Daniel Negless put on a direct examination of our client on four conditions warranting rent abatement: a cockroach and mouse infestation, bathroom mold, extensive water damage and a malfunctioning refrigerator.

In its April 19 order, the court affirmed that the four conditions entitled our client to rent abatement in the amount of $8,100—a net judgment of nearly $2,000 against the landlord. Our client will also have $3,000 held by the court in escrow returned to her.
