Description of Program and Relief
Immunity to Businesses and Individuals
In response to the COVID-19 pandemic, the Governor of Oklahoma has signed into law Senate Bill 1946, which provides businesses and individuals with immunity from civil actions claiming an injury due to exposure or potential exposure to COVID-19. In order for a business or individual to be immune, the act or omission that is alleged to have created exposure to COVID-19 must be “in compliance or consistent with federal or state regulations, a Presidential or Gubernatorial Executive Order, or guidance applicable at the time of the alleged exposure.” If two or more sources of guidance are applicable to the conduct at issue, the business or individual is protected so long as the conduct at issue is consistent with “any applicable guidance.” Senate Bill 1946 does not discuss situations in which a business or individual attempts to follow applicable guidelines but is not fully compliant.
