Chris Boehning Publishes Article on Corporate Responses to Climate Change in Law360

Litigation partner Chris Boehning published the article, "D&O Treatment Of Climate Change Liabilities," in the Insurance, Environmental and Securities sections of Law360. The article reviews how the insurance industry is preparing for a potential increase in climate change litigation. With the unprecedented nature of the risks involved and the potential for massive litigation costs, D&O policy treatment of climate change liabilities is an increasingly salient issue defined by the uncertain shape and scope of future D&O climate-related claims. The authors conclude that while climate change litigation is underdeveloped at this point in time, insurance companies should still attempt to get ahead of the coming wave of climate-related litigation through the creation of innovative insurance products.
