Paul, Weiss Obtains Second Circuit and Trial Victories in Employment Cases Against the Port Authority

The Second Circuit has issued an opinion affirming the findings by a jury that promotion practices at the Port Authority of New York and New Jersey had a disparate impact on Asian-American police officers and intentionally discriminated against certain Asian-American police officers, including David Lim, a 9/11 hero who was rescuing people in the north tower of the World Trade Center when it collapsed. Paul, Weiss litigation counsel Karen King and litigation partner Susanna Buergel tried the case on behalf of the plaintiffs in March 2009 before the Honorable Miriam Goldman Cedarbaum. The Second Circuit's ruling also reversed the District Court's application of the continuing violation exception to the statute of limitations on the disparate impact claim, which will require a slight reduction on back-pay damages for certain of the plaintiffs, as well as a revised award on compensatory damages.

Paul, Weiss also won a second jury verdict in related lawsuits brought by Asian-American police officers alleging retaliation by the Port Authority in connection with their participation in the discrimination lawsuit. After a six-day trial before the Honorable Laura T. Swain and three days of deliberation, the jury returned a verdict in favor of two of the four plaintiffs and could not reach a decision on the other two plaintiffs, who will have an opportunity to retry their claims. The retaliation cases were tried by litigation counsel Karen King and associate Moira Weinberg. Litigation partner Susanna Buergel supervised the matter.
