Antitrust partner Chris Wilson, senior knowledge & innovation attorney Tim Haney and antitrust associate Hannah Burdette published a Law360 article on the implications for antitrust enforcement of the recent Live Nation jury verdict. In “Live Nation Shows States, Experts Key To Antitrust Verdicts,” published on May 8, the authors discuss the jury’s verdict finding that the companies unlawfully monopolized ticketing services to major concert venues, and tied artists’ use of amphitheaters controlled by Live Nation to the company’s concert promotion services. Notably, the verdict came after the U.S. Department of Justice settled with Live Nation midtrial, prompting 33 states and Washington, D.C., to continue the litigation on their own.
The jury verdict “demonstrates that monopolization remains an active area of enforcement and that state attorneys general will not simply defer to the DOJ or the FTC when they believe anticompetitive conduct warrants stronger action,” the authors note. They also observe that “the economic evidence marshaled by experts will play an important role in monopolization cases, both in determining whether claims survive to trial and in shaping how juries and judges ultimately receive them.”
