Rana Matared and Harut Minasian Discuss AI-Assisted Inventorship Under U.S. Patent Law in Chicago-Kent Journal of Intellectual Property

Litigation associates Rana Matared and Harut Minasian published an article in the Chicago-Kent Journal of Intellectual Property examining how AI-assisted inventions challenge traditional inventorship requirements under the Patent Act. In the article, “AI-Assisted Inventorship: A Problem for Inventive Conception,” published on July 6, the authors examine the legal and practical questions raised by AI’s growing role in generating inventions.

Rana and Harut note that the existing patent law framework could be adapted to address challenges posed by AI-generated inventions, stressing the importance of specific guidance from courts and the U.S. Patent and Trademark Office (USPTO). The authors analyze how the current framework requires humans to "conceive" of the invention, despite assistance from AI.
