Because of their public and expansive nature, congressional investigations and oversight proceedings pose unique challenges and threats to a company’s business and brand. Paul, Weiss leverages the specialized skills and knowledge such matters require, fielding a team with significant hands-on experience to ensure that clients can safely navigate such inquiries.

Our Practice

Companies and individuals confronting congressional scrutiny face a raft of legal, reputational and collateral risks. Meanwhile, the intense publicity and politics inherent in such proceedings are outside the comfort zone and experience of most litigators. A strategic response requires the skills and judgment that can only be derived from direct experience of such investigations and how they unfold.

Paul, Weiss offers clients this experience and knowledge. We have safely guided senior executives of the world’s foremost companies and financial institutions through dozens of congressional investigations and oversight proceedings. We offer a deep familiarity with the congressional investigations process, and the culture, protocols and key investigative staff of particular congressional committees and subcommittees. We are adept at handling document and information requests or subpoenas, as well as preparing witnesses for testimony. The firm has advised clients on inquiries by all major congressional investigative committees, including the new House Select Subcommittee on the Coronavirus Crisis. We have also represented clients in inquiries by the GAO, various inspectors general, and state oversight bodies.

Our team includes lawyers with substantial experience testifying before oversight bodies in their past roles within the Executive Branch, as well as lawyers with significant government and private practice experience defending significant congressional investigations. The team includes a former Secretary of Homeland Security; a former U.S. Attorney General; a former top member of Special Counsel Robert Mueller’s office; two former Associate White House Counsels; a former Communications Director to former Sen. Hillary Clinton; and former senior officials at the Department of Justice, the Treasury Department, the FTC, and the New York Attorney General’s Office, among others.

Working seamlessly with government relations and public relations professionals, we craft strategies that take into account the political climate and media dimensions. Our strategy is also informed at every stage by the substantive knowledge of the legal implications of statements made in such public proceedings.
