A partner in the Litigation Department, Jessica Benvenisty focuses on complex commercial litigation across a range of industries, including real estate, media and entertainment, sports, technology and manufacturing.

Jessica has litigated matters in state and federal courts at the trial and appellate levels, and regularly serves in first-chair roles before juries and judges and in arbitrations. She has extensive plaintiff-side experience, and has represented clients in various challenges to local, state and federal government actions. Jessica also advises asset managers in connection with their litigation-related investments.

Jessica’s representative matters include:

  • Madison Square Garden in multiple matters, including the defense of a widely covered lawsuit brought by a former professional basketball player arising from his ejection from the MSG arena in 2017.
  • Skillz Platform, Inc. in a number of cases, including a widely covered patent infringement trial against its competitor in connection with one of the company’s foundational patents, which ended in a favorable jury verdict and significant monetary award; and in two Lanham Act false advertising actions against competitors relating to the use of “bots” or algorithms.
  • Netflix Inc., along with a TV production company co-defendant, in a copyright infringement action in the District of New Jersey relating to the reality television show King of Collectibles, resulting in a full dismissal of all claims.
  • An online health services company (NextMed) in a trade secrets action against its former cofounder and a competing telehealth business, alleging misappropriation of client lists, pricing data and marketing analytics, securing a preliminary injunction in the Southern District of New York that led to a favorable resolution.
  • An oil and natural gas company in a multifaceted representation relating to an industrial accident.
  • A group of New York property owners and the Rent Stabilization Association in a constitutional challenge to New York State’s COVID-19 residential eviction moratorium, securing an extraordinary emergency injunction from the U.S. Supreme Court partially enjoining the moratorium’s enforcement on due process grounds in Chrysafis v. Marks (2021).
  • Nike and Converse in a trademark infringement action in the Southern District of New York against more than 190 defendants selling counterfeit products, securing a preliminary injunction and asset freeze that ultimately shut down the defendants’ operations.
  • The BlackChamber Group in litigation against a public utility in connection with the development of a data center.
  • The State of New Jersey in a challenge to the federal environmental review underlying New York City’s congestion pricing program.
  • A construction and engineering firm in mass toxic tort litigation.
  • A consortium of plastics manufacturers, recyclers and restaurants in their challenge to New York City’s ban on extruded polystyrene (commonly known as Styrofoam™) products.
  • A private religious school in the defense of a defamation and employment discrimination action brought by a former teacher accused of improper conduct, resulting in a full dismissal.
  • A UAE-based manufacturer in an arbitration against its American supplier, presenting testimony of a key fact witness at trial, resulting in a multimillion- dollar award for the distributor.

Jessica was named a Rising Star in Trials by Law360 (2024) and has been recognized by Best Lawyers in America in Commercial Litigation (2021, 2022, 2024).

During law school, she served as submissions editor of the Columbia Science and Technology Law Review.
