Natalie Kennedy is a counsel in Paul, Weiss’s New York office and a member of the firm’s Patent Litigation practice. She has represented clients in disputes in district court, inter partes and post grant review proceedings before the U.S. Patent & Trademark Office, and investigations before the U.S. International Trade Commission. Her work also includes considerable experience advising clients in pre-litigation analysis and strategy. She has also counseled clients on numerous occasions in patent-related due diligence matters and licensing arrangements.
Natalie’s experience has been focused primarily in matters involving the life sciences and pharmaceuticals sectors, including BPCIA and Hatch-Waxman matters, disputes involving drug delivery devices, and patent and related matters for biotechnology and genomics companies. She has been involved in all aspects of litigation from early preparation through trial, including patent portfolio analysis and pre-litigation strategy; expert vetting and inventor interviews; BPCIA “patent dance” exchanges; claim construction; depositions; expert discovery, including laboratory testing experts; witness and cross-examination preparation for trial; and other aspects of trial coordination.
Natalie’s representative matters have included:
- A pharmaceutical company in competitor patent and antitrust litigation across the ITC, District Court, PTAB and Federal Circuit regarding its blockbuster drug product, including defeating a competitor’s attempt to obtain an exclusion order at the ITC and invalidating the asserted patent in an IPR final written decision that was affirmed by the Federal Circuit;
- A pharmaceutical company in multiple BPCIA litigations relating to an eye treatment drug product;
- A spatial biology company in district court litigations involving patent claims relating to instruments and assays for analyzing cancerous tissue samples;
- A pharmaceutical company in district court litigation, inter partes review proceedings and Federal Circuit appeals relating to insulin formulations and insulin delivery devices;
- A life sciences company in district court litigation relating to droplet digital PCR;
- A genetic testing company in inter partes review proceedings at the PTAB relating to cancer diagnostics; and
- A pharmaceutical company in a post grant review proceeding at the PTAB relating to antibody compounds to treat cancer.
Natalie was a member of the Fordham Law Review at Fordham University School of Law, attending law school in the evening while working full time as a patent agent at a large international law firm. Prior to attending law school, Natalie had extensive laboratory experience in the biomedical sciences, including dissertation work for which she received a Ph.D. in molecular physiology and biological physics.
