Real estate partners Peter Fisch and Salvatore Gogliormella’s latest Expert Opinion column, “Continued Benefits of Title Insurance Despite Growth of RWI,” was published in the July 31 issue of the New York Law Journal. The authors discuss the growing use of representations and warranties insurance (RWI) in commercial real estate transactions and explain why it remains a complement to, rather than a replacement for, title insurance. While RWI can shift post-closing liability from sellers to insurers and facilitate smoother deal execution, title insurance continues to provide important protections that RWI often cannot replicate, including broader coverage for certain title defects, higher coverage limits, the absence of deductibles, and protection that generally continues for as long as the insured retains an interest in the property. The article also highlights the continuing importance of title insurance in financing transactions, in which lenders typically require title coverage to insure the validity and priority of their mortgage liens.
