Cybersecurity & Data Protection Practice Group Chair John Carlin spoke with Bloomberg Law about trends in cybersecurity. In the article, published on February 10, John discusses the current legal “gray area” surrounding beacons or canaries—devices that, once stolen, could signal the location of a bad actor or stolen data. “If you use that beacon to cause damage, then you’re looking more like a traditional hack back and you have the concerns about the Computer Fraud and Abuse Act,” John says. “But if it’s just signaling its location, what is that, essentially, is the question.”
