Litigation partners Ted Wells, Dan Toal, David Kessler and Will Marks were recognized in The American Lawyer’s “Litigation Daily” column for securing an appellate victory on behalf of ExxonMobil in a lawsuit brought by the City of New York. The city had alleged that ExxonMobil and other energy companies violated New York City’s Consumer Protection Law by misleading consumers about the environmental impact of fossil fuels and the companies’ commitments to clean energy. On October 8, the New York Appellate Division, First Department, affirmed the New York Supreme Court’s 2025 dismissal of the case.
