Litigation partners Lewis Clayton and Eric Stone’s latest intellectual property litigation column, “Determining the ‘Relevant Article of Manufacture’ in Assessing Design-Patent Damages,” appeared in the May 9 issue of the New York Law Journal. Using the Supreme Court’s 2016 decision in Samsung Electronics Co. v. Apple as a jumping-off point, the authors report on subsequent district court decisions that have begun to establish a test for determining the relevant article of manufacture. Litigation associate Michael Milea assisted in the preparation of this article.
