Real estate partners Peter Fisch and Steve Simkin co-authored an article with alumnus Spencer Compton, senior vice president and special counsel of First American Title Insurance Co., that appeared in the "Outside Counsel" column of the May 7 issue of the New York Law Journal. The article, "Foreclosing on a Mezzanine Loan Under UCC Article 9," examines strategies for mezzanine lenders in distress scenarios, the interplay between the various tranches of mezzanine lenders and mortgage lenders and the various remedies available to mezzanine lenders after default. Associate Emily Carey assisted with the preparation of the article. Senior vice president and general counsel of the UCC division of First American, James Prendergast, also contributed to the article.
