New York Law Journal published the latest federal e-discovery column by litigation partners Dan Toal and Geoff Chepiga, and deputy chair and counsel, e-discovery, Ross Gotler. In “Federal Court Provides Guidance on Discovery of Teams Messages,” published in the October 9 issue, the authors discuss a recent decision from the Northern District of Indiana addressing how Microsoft Teams messages should be searched, reviewed and produced in discovery. In Valcrum, LLC v. Dexter Axle Co., LLC, the court declined to require production of complete chat threads but held that producing only search-term hits was insufficient given the shorter and more informal nature of Teams conversations, and ordered the production of surrounding messages and unredacted chat threads. The decision highlights the importance of developing defensible search, review and production protocols that account for the conversational nature of modern workplace messaging platforms.
