Aidan Synnott Contributes to Report on Deferred and Non-Prosecution Agreements in Antitrust Cases

A report titled "Oil in the Joints or Monkey Wrench in the
Gears: Deferred and Non-Prosecution Agreements in Antitrust Cases,"
authored by the Antitrust Committee of the Federal and Commercial
Litigation Section of the New York State Bar Association, recently
appeared in the fall issue of the NY Litigator. The report
examines whether the uptick in deferred and non-prosecution
agreements in antitrust cases reflects a shift in the Antitrust
Division's enforcement policy, and, if it does, the potential
effects of such a shift. In addition, the report discusses the
factors that the Antitrust Division might consider in determining
whether to offer a prosecution agreement in a particular
case.
