Paul, Weiss Achieves Victory for Incarcerated Client

Paul, Weiss and the Legal Aid Society achieved a victory for an incarcerated client and her newborn son, allowing the two to stay together in the Bedford Hills Correctional Facility Nursery Program rather than be separated at her son's birth. The client was initially denied entry to the Nursery Program by prison officials based solely on her past involvement with Child Protective Services and her past struggles with drugs and alcohol. Arguing that prison officials failed to consider a totality of factors as required under New York Correction Law 611 in determining the best interests of the client's child, and pointing to the client's demonstrated rehabilitation and other factors relevant to her son's welfare, Paul, Weiss obtained a temporary restraining order on August 1. The TRO will allow mother and son to remain together in the Nursery Program pending a decision on the merits.
