Litigation partner Lew Clayton's "Patent Law" column appears in the May 19 issue of The National Law Journal. The article discusses the ongoing debate over how damages should be assessed in cases where a small amount of patented technology is incorporated in complex products. Congress is debating legislation that would codify, and conceivably modify, the "entire market value" rule, which is sometimes used to set a reasonable royalty in such cases. Litigation associate Benjamin Warlick assisted in the preparation of this article.
