David Lakhdhir and Mark Bergman Publish Article in Law360 on EU Carbon Tax On Imports

Corporate partners David Lakhdhir and Mark Bergman co-authored “US Cos. Must Prepare For EU Carbon Tax On Imports,” a piece in Law360’s “Expert Analysis” section. The authors discuss a carbon border adjustment mechanism being contemplated as a facet of the so-called European Green Deal. The mechanism would impose a tax on goods imported into the EU, which would reflect the amount of carbon emissions attributed to their manufacture and inputs. The authors note that companies that export U.S.-manufactured goods—particularly ones associated with high levels of carbon emissions—to EU countries should monitor this development to anticipate the risk it presents and take advantage of any cost mitigation opportunities. This is also an issue ripe for discussion between the Biden administration and the EU.
