Walt Brown, Melinda Haag, Josh Hill and JiLon Li Publish Article on White Collar Enforcement Policy in The Recorder

Litigation partners Walt Brown, Melinda Haag and Josh Hill and associate JiLon Li co-wrote an article in The Recorder on the DOJ’s enforcement priorities under the Biden administration. In “What to Expect from the Next Era in White Collar Enforcement,” published on March 1, the authors discuss policy statements over the past several months, including Deputy AG Lisa Monaco’s memorandum outlining new guidance on enforcement goals; the DOJ’s vigorous pursuit of enforcement actions in the foreign affairs space; developments in the antitrust and fraud spaces; and DOJ policy statements in 2023 including DOJ’s recent corporate voluntary self-disclosure policy.

“Despite mixed success in its litigations, the DOJ has made clear that it intends to continue and expand its 2022 efforts into 2023. These include an emphasis on incentives for corporate self-disclosure and cooperation, work with international partners and pursuit of individual accountability,” the authors write. “Companies and individuals with international activities and in the agriculture, cryptocurrency and health care industries should be aware of and plan for the DOJ’s interest in these areas.”
