Becton, Dickinson Obtains Victory in Nationwide Class Action

Paul, Weiss client Becton, Dickinson and Company obtained a victory when the United States District Court for the Southern District of Georgia dismissed all the antitrust claims in a nationwide class action brought by two Georgia hospitals, purportedly on behalf of all hospitals in the country, alleging Sherman Act violations in the sale of syringes and IV catheters. The court held that the plaintiffs had no standing and, in any event, failed to state a claim for monopolization under the Sherman Act.
