Transactional Real Estate: Considerations for Ground Rent Reset Provisions

Real estate partners Mitch Berg and Peter Fisch’s latest transactional real estate column, “Considerations for Ground Rent Reset Provisions,” appeared in the December 18 issue of the New York Law Journal. The authors discuss considerations—such as defining the value of the land, and allocation of value for  upzoning  and assemblage premiums—for landlords, tenants and their lenders to take into account when contemplating rent reset clauses for ground leases.
