Brad Karp, Kannon Shanmugam and Lynn Bayard Recognized by The American Lawyer for NFL Win

Firm Chairman Brad Karp and litigation partners Kannon Shanmugam and Lynn Bayard were recognized in The American Lawyer’s May 17 “Litigation Daily” column for their Nevada Supreme Court win for the NFL and Commissioner Roger Goodell compelling former Las Vegas Raiders coach Jon Gruden to arbitrate his claims in a dispute over a 2021 email scandal.
In his lawsuit, Gruden claimed that the league leaked his racist, sexist and homophobic emails to the Wall Street Journal to “publicly sabotage” his career. A Nevada state court denied our motion to compel the claims to arbitration under both the NFL constitution and Gruden’s former employment contract with the Raiders. On appeal, the Nevada Supreme Court reversed that decision, holding that the constitution’s arbitration provision survived the termination of Gruden’s employment with the Raiders, and that Gruden’s emails constituted “conduct detrimental” to the league and thus was subject to the constitution’s arbitration provision.
