The second part of litigation counsel Bob Kravitz's article on the "puffery" defense in securities cases appears in the Spring 2009 issue of the ABA Securities Litigation Journal. The first part of the article, which appeared in the Winter 2009 issue, surveyed the published appellate court opinions on the "puffery" defense in the First through Fifth Circuits. The second part examines cases in the Sixth through Eleventh Circuits as well as new cases in the Second and Fifth Circuits that were issued after part one of the article was published.
