The article, "Hard-Learned Lessons," discusses the effects of the long-anticipated revisions to the Federal Rules of Civil Procedure in the context of a recent opinion in In re NTL, Inc. Securities Litigation. According to the authors, this case "serves as a pointed reminder that basic issues of electronic discovery practice continue to trip up even large and sophisticated litigants."
