Litigation partners Marty Flumenbaum and Brad Karp's "Second Circuit Review" column appeared in the January 28 issue of the New York Law Journal. The article discusses an important Second Circuit decision, Life Settlements Corp. v. Syndicate 102 at Lloyd's London, where the court determined that an arbitrator cannot compel prehearing discovery from nonparties. The decision deepened an already existing split among the circuit courts on this significant issue. Litigation associate Jaren Janghorbani assisted in the preparation of this column.
