Description of Program and Relief

Moratorium on Evictions

The City of Berkeley adopted an emergency ordinance prohibiting evictions during California’s COVID-19 State of Emergency for residential and commercial tenants for non-payment of rent and for those in default of mortgage payments, if the occupant demonstrates that the inability to pay is due to COVID-19, the State of Emergency regarding COVID-19, or following government-recommended coronavirus precautions. The ordinance also prohibits no-fault evictions, except for those necessary for public safety or because the landlord is going out of business. The ordinance does not excuse payment of rent, which will still be due to the landlord during the moratorium.

Effective March 17, 2020 through the end of the declared local state of emergency (currently June 21, 2020).

Eligibility Requirements/Restrictions

Tenants must notify their landlord no more than 7 days after the rent is due.

The occupant must demonstrate that:

(1) the basis for the eviction is nonpayment of rent, or a foreclosure, arising out of a substantial decrease in household or business income (including, but not limited to, a substantial decrease in household income caused by layoffs or a reduction in the number of compensable hours of work, or a substantial decrease in business income caused by a reduction in opening hours or consumer demand), or substantial out-of-pocket medical expenses; and

(2) the decrease in household or business income or the out-of-pocket medical expenses was caused by the COVID-19 pandemic, or by any local, state, or federal government response to COVID-19, and is documented.
