Moratorium on Residential Evictions For Renters Affected by COVID-19

The Alameda County Board of Supervisors has approved a moratorium on residential evictions specific to non-payment of rent or mortgage payments due to financial impacts caused by COVID-19. The eviction moratorium does not relieve tenants or homeowners of the obligation to make rent or mortgage payments. Under the moratorium, tenants have 12 months from the date the rent became due to repay what is owed, though landlords are free to agree to a separate repayment plan. After 12 months, landlords may collect payments that became overdue during the local health emergency as a consumer debt, but may not evict on the basis of that overdue rent.

The Alameda County Board of Supervisors has additionally approved a more general moratorium on residential evictions during the local health emergency. Under this moratorium, landlords and lenders are prohibited from evicting tenants and homeowners, regardless of cause, with limited allowances for: taking the residential unit off the market, complying with a government agency or court order, and imminent threats to health or safety (other than COVID-19 illness or exposure).

Dates Available

The specific moratorium on evictions based on non-payment caused by COVID-19 is in effect until May 31, 2020, and may be extended if the Governor of California extends the available dates of statewide protections against eviction.

The general moratorium on evictions during the local health emergency is in effect until July 20, 2020 (or 30 days after the termination of the local health emergency).

Eligibility Requirements/Restrictions

All residents in cities within the County of Alameda or in its unincorporated areas are protected by the county ordinance unless applicable specific city ordinances provide stronger protections than the county ordinance.

Residents seeking protection from evictions for non-payment of rent due to a substantial loss of income, medical expenses or extraordinary child care needs caused by COVID-19 must provide supporting documentation.
