Description of Program and Relief

Paid Sick Leave Ordinance

As an existing benefit, Oakland’s Paid Sick Leave Ordinance requires that Oakland workers performing at least two hours’ work per week accrue paid sick leave at a rate of one hour per 30 working hours. Employers with less than 10 employees must allow employees to accrue up to 40 hours of paid sick leave, and employers with 10 or more employees must allow employees to accrue at least 72 hours of paid sick leave. App-based or “gig” workers qualify for coverage under the law.

Workers may use paid sick leave when they are ill or injured or in order to receive medical care. Workers also may use paid sick leave to take care of family members who are sick.

Employers may take only reasonable measures to confirm a worker’s eligibility for sick leave. All workers are by default eligible for paid sick leave unless an employer proves otherwise. Workers may not be required to find or confirm a replacement if they need to use sick leave to care for themselves or others.
