Temporary Restriction on Certain Commercial Rent Increases

The Berkeley City Council has amended the COVID-19 emergency ordinance to prohibit landlords from increasing rent more than 10% over rates on March 10, 2020, for commercial tenants meeting the eligibility requirements below. This prohibition will be in effect until July 28, 2020, the expiration date of the extended statewide Governor’s Executive Order on eviction protections.

Eligibility Requirements/Restrictions

The commercial rent increase restrictions apply to any business that had a business license in 2019 or 2020 in the City of Berkeley, or nonprofit that was registered both of those years, and: (1) whose operations have been shut down by the COVID-19 state of emergency, (2) that cannot accept customers at its current location and is open for limited, virtual, take-out or pickup services only, or (3) that has suffered a material loss of income.
