Description of Program and Relief

Relief for Restaurants and Bars Serving Alcohol

Illinois has enacted a statute, House Bill 2682, permitting Illinois restaurants and bars to sell cocktails for pick-up and delivery.

For liquor license holders whose business operations were suspended in any capacity due to an executive order or agency rule related to COVID-19, the statute also:

  • waives late filing fees for liquor license holders;

  • defers temporary liquor license fees;

  • automatically approves liquor license renewals; and

  • precludes the licensee from being deemed delinquent for exceeding the thirty-day merchandising credit limit.

Pickup and delivery of cocktails are permitted until June 2, 2021.

The late filing fee waiver and deferral of temporary liquor license fees are in effect until six months after the later of the expiration of any executive order or rules that limit the business interruption, or the region in which the liquor licensee is located enters Phase 4 of the Restore Illinois Plan.

The liquor license renewals are extended until 120 days after the later of the expiration of any executive order or rules that limit the business interruption, or the region in which the liquor licensee is located enters Phase 4 of the Restore Illinois Plan.

Retail licensees shall not be deemed delinquent under the thirty-day credit merchandising rule until thirty days after the date on which the region in which the liquor licensee is located enters Phase 4 of the Restore Illinois Plan.

Alcoholic beverages must be served in a sealed container with a tamper-proof lid, and drivers delivering mixed drinks must store them in a trunk or other compartment inaccessible to them while operating the motor vehicle.

Third-party delivery services cannot deliver alcoholic beverages under this program.
