Description of Program and Relief

Reopening of Certain Business and Operations

Pursuant to Executive Order 2020-77, Governor Whitmer extended the “Stay Safe” order to May 28, 2020 but announced that businesses and operations that employ critical infrastructure workers or workers who perform resumed activities, including manufacturing, construction, certain real-estate activities, and other work that is traditionally and primary performed outdoors, may continue in-person operations, subject to certain conditions described in the Executive Order, as well as any countervailing city or county restrictions.

On May 18, 2020, Governor Whitmer signed Executive Order 2020-92, allowing for the reopening of retail businesses, office work that cannot be done remotely, and restaurants and bars with limited seating in Regions 6 (Traverse City Region) and 8 (Upper Peninsula), as detailed in Governor Whitmer’s MI Safe Start Plan to re-engage Michigan’s economy.

Region 6 in the MI Safe Start Plan includes the following counties: Manistee, Wexford, Missaukee, Roscommon, Benzie, Grand Traverse, Kalkaska, Crawford, Leelanau, Antrim, Otsego, Montmorency, Alpena, Charlevoix, Cheboygan, Presque Isle, and Emmet.

Region 8 in the MI Safe Start Plan includes the following counties: Gogebic, Ontonagon, Houghton, Keweenaw, Iron, Baraga, Dickinson, Marquette, Menominee, Delta, Alger, Schoolcraft, Luce, Mackinac, and Chippewa.

Eligibility Requirements/Restrictions

Critical infrastructure workers include those described by the Director of the U.S. Cybersecurity and Infrastructure Security Agency in his guidance of March 19, 2020 on the COVID-19 response (available here) and in section 9 of Executive Order 2020-77. Workers who perform resumed activities are listed in section 10 of Executive Order 2020-77. Businesses, operations, and government agencies that remain open for in-person work must follow the applicable guidelines specified in Executive Order 2020-77, and particularly in sections 11, 12, 13, and 15, including developing a COVID-19 preparedness and response plan, consistent with recommendations in Guidance on Preparing Workplaces for COVID-19, developed by the Occupational Health and Safety Administration (available here).

All businesses that will reopen in Regions 6 and 8 must adopt the safety measures outlined in Executive Order 2020-91, including, among other things, providing COVID-19 training to workers. Restaurants and bars will have to limit capacity to 50% of their normal seating, to keep groups at least six feet from one another, to require their servers to wear face coverings, and to follow rigorous disinfection protocols.
