Description of Program and Relief

Recommencement of the Execution of Eviction Writs

Service Bailiffs have been authorized to execute any writ of restitution issued between March 9, 2020 and June 1, 2020, as well as any writ of restitution for which a return was filed marked as “expired” between March 9, 2020 and June 1, 2020. Plaintiffs will not be required to pay for the execution of the these writs, unless they seek a supervised set-out and have not previously paid the $45 fee. Plaintiffs or their attorneys should contact the Service Bailiff’s office to schedule a set-out.

Service Bailiffs will not be required to issue “supplemental” or “alias” writs. Additionally, no order granting the right to immediate set-out will be granted between June 1, 2020 and July 1, 2020 except for exigent circumstances (e.g. criminal activity).
